Terms & Conditions
A. GENERAL
A.1. I declare that I am the registered owner of all horses entered for this Sale or am acting with full authority from and on behalf of the registered owner.
ACTING AS AGENT: If you are acting on behalf of the registered owner, the registered owner’s name must be declared.
A.2. NOMINATIONS CLOSE ON DATE STATED ON FRONT PAGE OF THIS FORM.
A.3. Only horses registered in the General Stud Book of South Africa at the time of the sale will be auctioned.
A.4. The Association, in conjunction with the Selection, Inspection and Screening Panels and Official Auctioneers, reserves the right to:
a) Accept or reject any nomination
b) Reject any horse that was previously accepted for the sale.
c) Accept late entries
NOTE: It is a condition of nomination that the owner/breeder or agent agrees to accept the inspectors as assigned by the Association/Auctioneers to inspect and/or
screen his/her horses without reservation.
A.5. Vendors will be required to notify the Auctioneers in writing on the day of the sale of each lot’s reserve price if any. Special slips will be provided for this purpose. If no
price is stipulated, the particular lot will be considered on the market and will be sold to the highest bidder.
A.6. This sale is subject to the full T.B.A. Conditions of Sale and Purchase as published in the sales catalogue of the sale.
A.7. B.S.A. shall be entitled to deduct from the proceeds of the sale of any of the vendor’s entries, whether or not the vendor is acting as a principal or an agent, any
amount which may be due to B.S.A. by the vendor or any of his principals.
A.8. The vendor by completing and/or signing this entry form acknowledges:
8.1 that he is aware of and accepts the Conditions of Sale and Purchase (“the Conditions”) relating to the auction sale (“the sale”) of thoroughbred horses contained in
the catalogue distributed prior to or at the sale
8.2 that he fully accepts and agrees to be bound by the Conditions, as amended from time to time, and in particular that, if acting as an agent on behalf of a principal,
he warrants his authority to so act and agrees to jointly and severally be liable with his principal for the fulfilment of the vendor’s obligations in terms of the Conditions.
A.9. The Association reserves the right not to accept entries from any vendor who for whatever reason is in debt to B.S.A.
A.10. The Vendor is responsible for ensuring that all horses entered are fit for sale and are delivered to the sale yards free of contagious and infectious diseases.
A 11. The Vendor is to deliver NHA Regulation Passports to B.S.A. on arrival at the sales venue. Such passports to be updated at the cost of the Vendor prior to the sale. It is an express condition of entry that all horses are vaccinated in accordance with the rules of the
NHA of South Africa. In this regard special mention is made of A.H.S. and Equine flu.
A.12 Unregistered horses will be refused access to the sales venue.
B. FEES
B.1 ENTRY FEE
An entry fee of R3 450 (R3 000 + R450 VAT) per horse which is NON refundable, must accompany this form.
B.2 ACCEPTANCE FEE
An acceptance fee of R3 450 (R3 000 + R450 VAT) is payable for each lot accepted for the catalogue. Vendors will be
notified of acceptance by 01 February 2021. This fee will be deducted from sales proceeds of the Vendor.
B.3 A sales levy at a rate of 8% (excl. VAT) of the sales price.
B.4 A compulsory reserve commission of 5% (excl. VAT) will apply to the sale.
B.5 A levy of R2 300 (R2 000 + R300 VAT) will be raised against every horse that has passed through the sales ring (sold and
unsold) to fund the Added Value Stakes Incentive. This levy will be deducted from sales proceeds of the Vendor.
B.6 No late entries will be accepted.
C. MINIMUM LEVY
No minimum levy is payable on this sale.
NOTE: NOTWITHSTANDINGTHE ABOVE, WHEN A VENDOR PLACES A RESERVE PRICE ON A HORSE AND THE HORSE IS NOT
SOLD IN THE RING, THE LEVY WILL BE CALCULATED AT 5% (EXCL. VAT) ON THE RESERVE PRICE.
D. PENALTY LEVY ON WITHDRAWALS
D.1 When a horse is withdrawn from the sale without producing an acceptable veterinary certificate, stating that the horse is unfit for sale
due to injury or illness the penalty levy payable will be calculated as follows:
8% (excl. VAT) of the average price realised on the particular category in which the horse has been entered in this sale.
Veterinary certificates must be lodged with B.S.A. prior to the start of the sale.
D.2 A levy of 8% plus VAT shall be payable on the price realised if the Horse is sold by auction or private treaty by the Association;
the Vendor, his agent or representative at any time during the period commencing upon acceptance of the Horse for this Sale
and concluding 60 days after the Sale has been held.
E. PEDIGREE COMPILATION
E.1. All pedigrees will be compiled by BloodStock SA. The cost of compiling pedigrees is included in the entry fee.
Vendors must examine their horses’ pedigrees and report any corrections/inaccuracies to the auctioneer prior to the sale.
F. MINIMUM PRICE
The minimum price which will be accepted for any horse in the sales ring is R50 000
G. INSPECTIONS
All horses will be inspected at the sales ground. B.S.A. reserves the right to remove any horse that in the opinion of the inspectors is unfit
for sale. The vendor will be liable for all costs.
H. The yard will be open for horses from Friday, 2nd April 2021
N.B.: FAILURE TO COMPLY WITH ANY OF THE CONDITIONS AS STIPULATED ABOVE WILL RESULT IN THE NON-ACCEPTANCE
OF THE NOMINATIONS BY BLOODSTOCK SA.
